6 Pet Friendly Real Estate Rules in Toronto

In the already expensive city of Toronto, finding a home that’s just right for you and your furry friend isn’t always a walk in the park. But don’t fret! Whether you’re a dedicated dog lover or a committed cat person, as an experienced realtor in Toronto, I’ve got the scoop on navigating the top 6 pet-friendly real estate rules in Toronto.

If you’re a first-time homebuyer or renter, I’ll address some pressing questions pet owners often have when seeking a place to call home in Toronto.

1) Can a Landlord say No Pets in Ontario?

Here’s the lowdown. In Ontario, our pets are often considered part of the family, and the law takes a similar stance. Under the Residential Tenancies Act, any clause in a rental agreement prohibiting pets is void, so tenants generally have the right to keep pets. However, while the Act protects pet owners, it doesn’t compel landlords to rent to them. So, a landlord might still choose to rent to someone without pets.

2) Are Condos Pet Friendly in Toronto?

That’s the million-dollar question! Condo policies differ across Toronto, with each condominium corporation setting its own rules. Some buildings have pet friendly real estate rules in Toronto and warmly welcome pets, while others might set limits. Common restrictions include a cap on pet numbers (often two cats and/or dogs), breed restrictions, prohibitions on breeding, and weight limits of about 25-40lbs.

Remember the golden rule of condo living – being a good neighbour! Even if pets are welcome, they should be leashed in common areas, and it’s essential to clean up after them. Persistent barking can also ruffle feathers in these close-knit communities.

3) Can a Landlord Evict you for Having Pets in Ontario?

Here’s where things get a little tricky when it comes to pet friendly real estate rules in Toronto. While landlords can’t evict you just for having a pet, they can apply to the Landlord and Tenant Board to terminate tenancy under specific circumstances. These include if your pet is causing significant disturbance to other tenants, someone is having a severe allergic reaction to your pet, or if your pet is considered dangerous. The landlord, however, must first give you a chance to rectify the situation. If the issues persist, eviction could be on the cards.

4) Can a Landlord Charge Extra for Pets in Ontario?

The short answer is no. In Ontario, landlords cannot demand extra rent for pets. This is an important pet friendly real estate rule to know. It’s illegal to do so under the Residential Tenancies Act. However, if your pet causes damage beyond usual wear and tear, you may have to pay for repairs.

Now that we’ve got those pet questions sorted let’s look at the condo scene in more detail.

5) Pet Friendly Real Estate: Are Condo Pet Regulations Enforceable?

Yes, but the extent can vary. Some condos are pretty lax about enforcing pet restrictions, while others take it very seriously. A common method for managing violations is a ‘three-strike’ system – after three warnings, your pet might face eviction. Sounds scary, right? But keep in mind, evicting a pet isn’t as simple as posting a notice on your door. It’s a legal process involving lawyers and a possible monetary settlement if the condo corporation wins the case.

This is why it’s crucial to understand your building’s pet policy before moving in and find out if the pet friendly real estate rules. If you unknowingly break the rules and face legal consequences, not only could you be ordered to comply or pay legal costs, but a lien could also be registered against your unit.

6) What if I Buy a Condo in a ‘No-Pet’ Building?

If you’re a daredevil who’s moved into a no-pet building with your beloved pet, you might be playing a risky game. While many condos don’t strictly enforce pet restrictions, especially if your pet is well-behaved, it’s still a gamble. A safer bet is to choose a building with a pet-friendly policy, ensuring peace of mind for you and a warm welcome for your four-legged friend.

Living with pets in Toronto doesn’t have to be a cat-and-mouse game with your landlord or condo board. With the right information and respectful pet etiquette, you can find the perfect home in any Toronto neighbourhood for you and your furry family member. Remember, Toronto is a city filled with animal lovers just like me and you. There’s a place for everyone, including our pets. But when in doubt, consult with a lawyer well versed on the Ontario Tenancy Act and the rules about pets in rental homes and condos.
